Sierra County mine agrees with U.S. EPA to install wastewater treatment, protecting local waterways
 

SAN FRANCISCO —Today, the U.S. Environmental Protection Agency (EPA) announced that Sixteen to One Mine, one of California’s oldest operational gold mines, has agreed to an Administrative Order on Consent requiring the mine to install a new treatment system that will remove pollutants from mine drainage before entering local waters. The mine was found to be in violation of its permit under the U.S. Clean Water Act after consistently discharging mine-influenced water that exceeded limits on pollutants. The Sixteen to One Mine, located in the Tahoe National Forest, discharges into Kanaka Creek, a tributary of the Yuba, Feather, and Sacramento Rivers.

“Under the Clean Water Act, industrial wastewater must be treated before it can be discharged,” said EPA Pacific Southwest Regional Director of the Enforcement and Compliance Assurance Division Amy Miller. “These upgrades will be critical to protecting public health and water quality in Sierra County.”

The agreement announced today addresses elevated pollutant levels by requiring the mine to install a system to treat total suspended solids, antimony, arsenic, cadmium, copper, lead, nickel, and pH to levels at or below permit limits. The Sixteen to One Mine has agreed to submit sampling and treatment plans, install an approved water treatment technology, repair stormwater management features in disrepair, update its stormwater management plan, and apply for coverage under the California Statewide Industrial General Permit.

The Sixteen to One Mine has 220 days to complete this work. The facility will report sampling results to EPA for three years to demonstrate the treatment system’s effectiveness, ensure compliance with the permit, and protect the water quality of Kanaka Creek.

En juillet dernier, deux incinérateurs de la mine Snap Lake de De Beers crachaient des nuages de fumée noire, l’un envoyant en moyenne 65 fois la limite nationale acceptée de toxines cancérigènes dans l’air.

Les niveaux extrêmement élevés de dioxines et de furanes – libérés lorsque le plastique est brûlé ou que les déchets ne sont pas entièrement incinérés – ont été enregistrés au cours d’un «test à la cheminée» de quatre jours. Selon l’Organisation mondiale de la santé, «les dioxines sont hautement toxiques et peuvent causer des problèmes de reproduction et de développement, endommager le système immunitaire, interférer avec les hormones et aussi provoquer le cancer.» Les normes pancanadiennes recommandent que les niveaux d’émission de dioxines et de furannes ne dépassent pas 80 picogrammes par mètre cube. La société mandatée pour effectuer les tests à Snap Lake a constaté que l’un des incinérateurs de la mine émettait 6,5 fois la limite acceptable, tandis que l’autre incinérateur émettait 65 fois la limite acceptable (5220 picogrammes par mètre cube en moyenne, comme

On ne sait pas combien de temps cela a duré, bien que le rapport indique que le problème était clairement visible: «Une fumée noire opaque a été notée pour tous les tests au début du cycle d’incinération.»

De Beers n’a pas répondu à la demande d’entretien d’EDGE au moment de la publication. Cependant, selon une lettre d’Alexandra Hood, surintendante de l’Environnement et des permis de De Beers, envoyée au GTNO et à Environnement Canada en janvier, la cause principale du problème était «de ne pas suivre les pratiques de travail normalisées» et de faire fonctionner les incinérateurs, qui étaient installé uniquement en 2013, à une température trop basse.

Depuis que le test a échoué, De Beers a recyclé le personnel, réécrit les procédures d’exploitation et introduit une nouvelle politique pour arrêter les incinérateurs s’ils ne respectent pas les températures correctes (si cela est sécuritaire), selon la lettre de Hood. Une inspection des incinérateurs de Snap Lake par un agent des terres du GTNO en mars suggère que De Beers a atténué le problème, au moins en partie: «Aucune préoccupation n’a été notée lors de cette inspection», déclare-t-il, et «l’incinérateur ouest qui brûlait des déchets à le moment de l’inspection émettait des gaz d’échappement clairs sans fumée noire provenant de la cheminée. »

Cependant, si des mesures suffisantes ont été prises ou non, cela ne sera pas connu avant des années: le prochain test de stack n’est pas prévu avant 2019, selon une source proche du dossier souhaitant rester anonyme.

Pas de règlement du GTNO

Le fait que, pendant une période indéterminée aux alentours de juillet 2014, les incinérateurs de Snap Lake pompaient des niveaux inacceptables d’émissions toxiques est problématique en soi. Mais cela indique un problème beaucoup plus vaste sur le territoire; le GTNO ne réglemente pas les émissions, n’oblige pas les entreprises à se conformer au SP ou n’impose pas de test de cheminée. (De même, l’Office des terres et des eaux de la vallée du Mackenzie ne réglemente pas les émissions atmosphériques.)

À plusieurs reprises dans sa lettre, Hood note l’absence de réglementation, affirmant que De Beers «se conformera à toutes les exigences réglementaires concernant les essais de cheminée d’incinérateur une fois que la législation habilitante sera élaborée et approuvée dans les TN-O.».

Sans législation en place, rien ne contraint De Beers ou d’autres groupes utilisant des incinérateurs (c’est-à-dire toutes les mines du territoire) à maintenir leurs émissions à un niveau sûr ou à entreprendre régulièrement des tests de cheminée. Chaque mine a un plan de gestion de la qualité de l’air et des émissions dans le cadre de son accord environnemental, mais ces plans ne dictent que les exigences en matière de rapports, pas les objectifs d’émissions réels. Et tandis que Hood affirme que «les lacunes, mesurées par rapport aux normes pancanadiennes, seront gérées par une gestion adaptative et une amélioration continue par De Beers», il y a peu de surveillance gouvernementale de cette «amélioration continue» et aucune amende ou autre mécanisme pour forcer les entreprises polluantes à remédier à leurs voies.

Ce problème dure depuis des années. Selon un rapport de la Presse canadienne de 2011, la revue scientifique Integrated Environmental Assessment and Management a trouvé des sédiments dans un lac près de la mine Ekati qui contenaient des niveaux de dioxines et de furanes 10 fois plus élevés que ceux recueillis dans un lac non contaminé. Le même rapport citait une étude de 2007 commandée par Environnement Canada qui suggérait que «le brûlage extensif et incontrôlé de déchets pourrait entraîner des accumulations substantielles de dioxines et de furanes dans l’écosystème local, dont certaines persisteront pendant environ 8 ans et demi à des niveaux proches de ceux considérés comme étant préoccupante sur le plan toxicologique. »

«Dans la plupart des cas, nous sommes en deçà du niveau que les agences de santé (surveilleraient)…» poursuit l’étude, «mais nous y arrivons. Et si vous avez plus d’incinérateurs et plus d’incinérateurs, vous risquez bien de dépasser ces niveaux. »

Le ministère de l’Environnement et des Ressources naturelles du GTNO n’a pas renvoyé la demande de commentaires d’EDGE sur l’absence de réglementation.

Pourquoi pas de réglementation?

En 2001, le GTNO a signé les Normes pancanadiennes sur les dioxines et les furannes avec toutes les autres provinces et territoires (sauf le Québec) dans le cadre d’un accord national sur l’harmonisation environnementale.

Le document dit: «Les Parties sont tenues de prendre des mesures pour réduire les rejets totaux de sources anthropiques de dioxines, furanes… dans le but de continuer à les minimiser et, si possible (techniquement et socio-économiquement), à les éliminer définitivement.» Cependant, ajoute-t-il, «chaque juridiction déterminera les moyens exacts d’assurer la conformité» – essentiellement en annulant le document en laissant les provinces et les territoires revenir sur leur engagement sans aucune répercussion.

D’autres juridictions ont pris des mesures proactives, introduisant une législation pour réglementer les émissions conformément au SCF. Le GTNO ne l’a pas fait. Ils ont apporté des lignes directrices pour la gestion des déchets biomédicaux en 2005, mais ils n’ont pas voulu réglementer les incinérateurs sur les sites miniers. Leur raison? Les «incinérateurs de déchets opérant dans des sites industriels éloignés des TNO… sont situés sur des terres de la Couronne fédérale et ne sont pas réglementés par le gouvernement des Territoires du Nord-Ouest», indique un rapport de 2009.

C’était peut-être vrai en 2009, mais ce n’est plus le cas après la déconcentration. Depuis avril de l’année dernière, les mines se trouvent sur des terres gérées par le GTNO, mais les législateurs n’ont pas fait de mouvement pour commencer à réglementer les émissions toxiques des mines ou d’autres incinérateurs industriels. La dernière fois que la question a été discutée à l’Assemblée législative en 2011, le député de Weledeh, Bob Bromley, a déclaré qu’une «faille dans les règles environnementales permettait à un nombre croissant d’incinérateurs de déchets non réglementés de rejeter des produits chimiques extrêmement toxiques dans la terre et l’eau. Il a suggéré: «lorsque nous prenons de nouveaux pouvoirs, nous devons être prêts à adopter une nouvelle loi.»

Le transfert des responsabilités est intervenu et les incinérateurs fonctionnent toujours dans un environnement non réglementé. Avec tous les discours sur la fracturation hydraulique et l’ouverture de nouveaux projets miniers dans le territoire, il est maintenant plus que jamais temps pour le GTNO de se ressaisir.

(Lenexa, Kan., August 23, 2021) – The U.S. Environmental Protection Agency (EPA) released three new resources to assist the agency’s state, territorial and authorized Tribal partners to address adverse effects of nutrient pollution, including freshwater harmful algal blooms (HAB). These resources will help EPA’s co-regulators and partners better protect recreators, aquatic life, and drinking water sources from the detrimental effects of nutrient pollution. The three resources include the agency’s Final Recommended Nutrient Criteria for Lakes and Reservoirs, a web-based tool with information and tracking of HABs, and a Technical Support Document to aid implementation of certain HABs criteria.
 
“EPA’s new resources advance the agency’s commitment to providing innovative, science-based and data-informed tools to support our partners’ efforts to reduce nutrient pollution and harmful algal blooms, and to empower the public to stay informed of their health risks,” said EPA Assistant Administrator for Water Radhika Fox. “With stressors like climate change exacerbating the effects of excess nutrients in waterways, it’s crucial that our partners have the water quality standards and advisory programs in place that can protect our communities.”
 
Final Recommended Nutrient Criteria for Lakes and Reservoirs
EPA has published revised recommended ambient water quality criteria under the Clean Water Act to help address nutrient pollution in lakes and reservoirs. As the first update to EPA’s nutrient criteria in 20 years, these recommendations represent a significant advancement in the scientific understanding of the impacts of nitrogen and phosphorus in our waters. These new criteria will help protect drinking water sources, recreational uses, and aquatic life in our nation’s lakes and reservoirs. The new recommendations are based on statistical stressor-response relationships developed from data collected in approximately 1,800 lakes nationwide and incorporated into national models.
 
The Agency wants to ensure that our co-regulators have the tools they need to implement their nutrient reduction priorities. The national models are designed so that states, territories, and authorized Tribes can also incorporate local data into the models to account for unique local conditions. EPA stands ready to assist our partners in using the new models through the agency’s Nutrient Scientific Technical Exchange Partnership & Support (N-STEPS) program. States, territories, and authorized Tribes can consider adopting the recommended criteria into their water quality standards but are not compelled to revise existing EPA-approved criteria or total maximum daily load (TMDL) targets.
 
Tracking CyanoHABs StoryMap
EPA has also published a a new ArcGIS StoryMap that will allow the public to learn about and track reported cyanobacterial HABs (cyanoHABs) in freshwaters across the country. CyanoHABs can harm ecosystems and contaminate freshwaters with toxins that can lead to serious human health impacts. There is scientific consensus that the incidence of cyanoHABs has increased in the nation’s freshwater systems in recent years, in part due to climate change. EPA’s Tracking CyanoHABs story map creates a single online resource for information about cyanoHAB events across the U.S. It consolidates freshwater advisory and closure information from state environmental and health agencies into user-friendly, interactive maps. In addition, the story map includes links to information on freshwater HABs causes and effects; several EPA tools on HABs preparedness and response; and state and local HAB resources such as the laboratories that perform analysis of water samples for cyanotoxins. We hope these maps can help the public better understand the occurrence of cyanoHAB events and our public and private sector partners further explore the causes of cyanoHAB formation.
 
Implementation Support for EPA’s Recreational HABs Criteria
To help states, territories and authorized Tribes protect swimmers from two cyanobacterial toxins (cyanotoxins) produced by cyanoHABs, EPA has also published Final Technical Support Document: Implementing the 2019 Recommended Recreational Water Quality Criteria or Swimming Advisories for Microcystins and Cylindrospermopsin. This document explains how states, territories, and authorized Tribes may adopt EPA’s 2019 recommended criteria for the two cyanotoxins into their water quality standards or use the criteria in swimming advisory programs. The document also addresses implementation of the 2019 criteria recommendations through other Clean Water Act programs including identifying and listing of impaired waters, and TMDL development.
